Terms of Service

1. Acceptance of Terms

By accessing or using the Jetweb Image Optimizer service ("Service") operated by Baduno GmbH ("we", "our", or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

Jetweb is an image optimization service that:

• Converts images to WebP and AVIF formats
• Reduces image file sizes while maintaining quality
• Provides CDN storage and delivery
• Offers a WordPress plugin for easy integration
• Provides an API for programmatic access

3. Account Registration

To use the Service, you must:

• Create an account with a valid email address
• Verify your email address
• Provide accurate and complete information
• Keep your login credentials secure
• Be at least 16 years of age

4. Subscription Plans and Billing

4.1 Free Plan

The free plan includes 100 image conversions per month with WebP conversion. No credit card required. Upgrade for AVIF and CDN access.

4.2 Paid Plans

Paid plans are billed monthly or yearly. Prices are in EUR and include German VAT where applicable.

4.3 Usage Limits

Each plan has specific limits for images, CDN traffic, and CDN storage. Exceeding these limits will prevent new conversions until:

• The next billing period resets your usage, or
• You upgrade to a higher plan

4.4 Plan Changes

• Upgrades: Take effect immediately. You will be charged the new rate.
• Downgrades: Take effect at the end of your current billing period.
• Cancellations: Your plan remains active until the end of your billing period.

5. Acceptable Use

You agree not to:

• Use the Service for illegal purposes
• Upload malicious or harmful content
• Violate intellectual property rights
• Attempt to circumvent usage limits
• Share your API keys with unauthorized parties
• Use the Service to distribute malware
• Overload or disrupt the Service

6. Intellectual Property

You retain all rights to your images. By using the Service, you grant us a limited license to process and store your images as necessary to provide the Service.

7. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We may perform maintenance with or without notice.

8. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" without warranties
• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount paid for the Service in the last 12 months

9. Termination

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent activity
• Fail to pay for your subscription

You may close your account at any time through the dashboard or by contacting support.

10. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance.

11. Governing Law

These Terms are governed by the laws of Germany. Any disputes shall be resolved in the courts of Frankfurt am Main, Germany.
